UPS found itself in a class action lawsuit when customers made claims that they were overcharged for shipping certain packages. If you had a package shipped by UPS between two U.S. locations on or after May 15, 2006, and August 29, 2011 and were charged an adjusted upwards fee as a result of UPS’s audit of package dimensions you could be a class member of this lawsuit. The case is entitled Barber Auto Sales, Inc., individually and on behalf of all persons similarly situated v. United Parcel Service, Inc and is in the jurisdiction of the United States District Court for the Northern District of Alabama.

The class members claim that their packages measurements of height, length, and width differed from those measured by UPS’s which resulted in paying more for shipping cost. UPS claim the packages were measured correctly but have agreed to $2,000,000 settlement fund in order to avoid any further litigation. A settlement fairness hearing will be held on 12/05/11 at the United States District Court for the Northern District of Alabama, Hugo L. Black U. S. Courthouse, located at 1729 Fifth Avenue North, Birmingham, AL 35203 to determine if the settlement is fair.

All exclusions and objections are due by 11/07/11. All Claim Forms must be postmarked no later than 30 days from the date of the Final Order and Judgment. The Final Order and Judgment date has not been set as of yet but it will be on or after the settlement fairness hearing. Please note that all exclusion request MUST be mailed to:
