www.EnergySettlement.com – Wise, et al. v. Energy Plus Holdings

If you were a customer of Energy Plus Holdings LLC or Energy Plus Natural Gas LLC in the states of New York, Maryland, Connecticut, New Jersey, Pennsylvania, Texas, Illinois, Ohio, or Massachusetts up to October 15, 2012 you may be part of a major class action lawsuit against Energy Plus.  The Energy Settlement revolves around claims that Energy Plus violated the laws when making misleading representations to consumers and that Energy Plus did not make their rates known because they were higher than prevailing market rates.  Please note that this lawsuit does not include Energy Plus Holdings LLC and Energy Plus Natural Gas LLC.  The defendants deny any and all actions of wrong doing but have agreed to settlement terms.  The current proposed settlement is each class member will receive a check for between $6 and $101 dollars or a gift card.  If the class member picks the gift certificate the certificate will rounded up to the nearest $5.00.  For example if your entitled to a $26 cash payment the gift certificate would be in the  amount of $30.  The gift certificate is the better value but cash is always good too.

You can file the claim form online at the Settlement Administrator website or call 1-888-344-6711 and request the form be mailed to you.  ALL clam forms are due by July 24, 2013 regardless of the way you file the claim.  The case is entitled Wise v. Energy Plus Holdings LLC and is Civil Number 11-7345.

The case will be heard in the U.S. District Court Southern District of New York.  All class members who opt to stay in the lawsuit will be represented by the law firm of D. Greg Blankinship Meiselman, Packman, Nealon, Scialabba & Baker P.C.  Energy Plus has hired the law firm of Duane Morris LLP to protect their interest.

www.SensitivityToothpasteSettlement.com – Rossi v. The Proctor & Gamble

Claims of misleading and deceptive advertising are the target of the class action lawsuit entitled Rossi v. The Proctor & Gamble Company.  Class members of the lawsuit claim that Proctor and Gamble made false claims about the Crest Sensitivity Treatment & Protection toothpaste when marketing it to customers.  The class members claim they would of not of bought the toothpaste if the truth about the product would of been known.  The label on the products claims that consumers of the toothpaste would feel rapid relief from tooth sensitivity “within minutes.”  Class members go on to state that the Crest Sensitivity Toothpaste “is essentially identical to Crest Pro-Health toothpaste,” only with a hefty price tag.  Proctor and Gamble deny any actions of wrong doing but have agreed to refund the purchase price of Crest Sensitivity toothpaste to Settlement Class Members who submit timely Claim Forms.  Class members in the case are defined as anyone who purchased Crest Sensitivity toothpaste from February 2011 through March 31, 2013.  This class action lawsuit should teach Proctor and Gamble to me more careful in regards to labeling their products and benefits.

Furthering strengthening the class members case was a statement released by Better Business Bureau’s National Advertising Division.  This may have been the most damaging piece of evidence in the case.  The statement read:

“While there is improvement in tooth sensitivity over time … NAD determined that the totality of the evidence was insufficient to support the advertiser’s ‘relief within minutes’ claims and recommended that they be discontinued.”

The deadline to file a claim in the Sensitivity Toothpaste Settlement is August 19, 2013.  To file a claim please go here.  The settlement fairnes shearing will take place on September 12, 2013 at the  United States District Court for the District of New Jersey Courthouse which is located at  United States District Court for the District of New Jersey.  In order to be eligible for a refund you must file a claim BEFORE the settlement deadline.

The Medical Capital Class Action Lawsuit is against Wells Fargo and BNYM.  The crux at the matter is if Wells Fargo and BNYM breached their contractual duties to investors by not properly monitoring funds that were used by Medical Capital.  Class members are claiming breach contractual duties to investors and claim that over $1 billion in Notes held by 8,323 investors are now in default due to this breach.  The case is entitled In re Medical Capital Securities Litigation and will be under the United States District Court for the Central District of California.  The lawsuit will be heard by the Honorable David O. Carter who received his law degree from University of California, Los Angeles in 1972.  It should be stated for the record that Wells Fargo and BNYM deny all and any actions of wrong doing in the case.  The court has appointed the law firms of Cotchett, Pitre & McCarthy, LLP and Westerman Law Corp. to represent all class member who do not option out of the lawsuit.  Important dates in the Medical Capital Class Action lawsuit include:

If you or someone you know shopped at a Unique, Unique Thrift, Valu Thrift, or Value Village retail store between the dates of April 13, 2010, and April 27, 2012 you might be a class member in the Hupperts v. Apogee Retail, LLC, et al. lawsuit.  The case will be held in the United States District Court for the District of Minnesota.  The stores mention above are operated in the states of Colorado, Kentucky, Maryland, Minnesota, Missouri, New Jersey, New York, and Virginia but please note you don’t have to be a resident of one of those states to be considered a class member.  The lawsuit itself revolves around customers who received receipts that contained the credit or debit card’s unredacted expiration date.  The court has not decided who is right or worn gin the case but both sides have agreed to a settlement.  All class members will be represented by Thomas J. Another class action lawsuit is pending over the misrepresentation of a products ingredients.  The Singer v. WWF Operating Company lawsuit claims that Whitewave purposely and deliberately misrepresented its products by tricking customers into thinking that “evaporated cane juice” is real “juice” when it is nothing more than sugar, cleverly disguised.  The court that has jurisdiction of the case is the United States District Court for the Southern District of Florida, Miami Division.  It should be noted that Whitewave does however list ECJ as an ingredient on its products, as well as on its website and other promotional material.  Only time well tell who is right and who is wrong.  The lead Plaintiff Brenda Singer in the SingerECJSettlement is a citizen of Florida.  The real dagger in the coffin for the WWF Operating Company is the official FDA statement that reads “According to the FDA’s published policy, “evaporated cane juice” is simply a deceptive way of describing sugar, and therefore, it is false and misleading to dress up sugar as a type of “juice.”.  In order to be part of the settlement class a claim form must be filed no later than OCTOBER 26, 2013 in order for it to be considered.  You must submit your Claim Form online at the class administrators website or print the claim form and mail it to: CPT Group, Inc., 16630 Aston, Irvine, CA 92606.
